The tenant undertakes not to transfer the subject of the agreement to anyone else under any circumstances whatsoever.
The extension/renewal of this agreement is at the sole discretion of the landlord. If the tenant does not renew the agreement on the expiry date, he will have to pay the rent as demanded.
The contract is valid up to the end date of the specified period, after which date it is considered null and void.
At the time of vacating, the tenant undertakes not to remove anything fixed or nailed on the walls, such as eclectic wirings, water pipes, sanitary installations, etc., which may cause damage to the wall.
If the tenant wishes to carry out repairs or adjustments to the subject of this agreement, he has to do it at his own expense but must advise and ask permission from the landlord.
If the tenant acts against any of the conditions in this agreement, the landlord has the right to eject the tenant from his premises instantly, and the tenant loses his rights under this agreement.
The tenant undertakes to pay all taxes levied by the government on the subject of the tenancy, such as municipality or other government taxes in force now or in the future.
If the tenant wishes to vacate the subject of this agreement or leave the town, he should officially inform the landlord and obtain his consent. If the tenant leaves without informing the landlord, the landlord has the right to open the premises in his capacity as the legal owner, and the tenant has no objection or claim in the future.
Extra Conditions for Foreign and Native Tenants:
If the tenant is absent from the town at the expiry of the agreement or leaves the premises without the landlord's consent or if he has not paid the balance of the rent due, the landlord shall have the right to open the premises and lease it to others he finds suitable.
The tenant shall be responsible for paying all the utilities, ADDC, gas bills, cooling bills, and any subscription directly to the relevant service providers.
Move-in will only be permissible once all payments have been received and credited to the landlord's bank account before the move-in date.
Unless the extension/renewal of this agreement is confirmed by both parties 60 days prior to the expiry of this agreement, the tenant must vacate the apartment(s) on the stipulated date in this agreement.
The landlord has the right to terminate the agreement with one month's notice (30 days).
The minimum stay period is 6 months from the contract start date.
Should the tenant decide to vacate the apartment before the expiry date of this agreement, the landlord must be informed in writing 1 month in advance. In this case, 2 months' rent penalty will be charged after move out, and if no notice is given, a 3 months' rent penalty will be charged by the landlord, and the balance payment refunded on a pro-rata basis.
An inventory list will be given to the occupant upon arrival. Upon moving out, an inspection will take place, and any missing items will be charged for and adjusted against the security deposit.
The apartment(s) cannot be used for any trade or business purposes. Any sort of illegal activity is strictly prohibited and may result in the immediate cancellation of this agreement without any liability to the landlord.
The security deposit will remain with the landlord until a comprehensive inspection is made to assess the condition of the apartment(s), its/their fixtures, and equipment. Any repair, change, or replacement needed will be made, and the corresponding amount deducted from the security deposit. A clearance certificate from ADC that all bills for water and electricity have been paid by the tenant, and the meters have been returned under the owner’s name, as well as a clearance certificate from the subcontractor that the gas connection has been disconnected, will also be required. The landlord pledges to settle the balance 10 days after all related invoices have been received.
The terms and conditions of this agreement, as well as the operational requirements of such type of accommodation, will be governed by the relevant authorities within the Emirate of Abu Dhabi.
